Academy Award-winning actress Halle Berry is taking her ex-partner Olivier Martinez back to court over their current custody arrangement for their 10-year-old son, Maceo.
Berry has filed documents seeking sole custody over Maceo’s education and medical decisions, citing Martinez’s alleged refusal to address their son’s learning and behavior issues.
According to Berry and her legal team, Martinez’s “turbulent behavior” and prioritization of Maceo’s soccer training over his education have resulted in the boy falling behind his peers. They also claim that Martinez refused to hire a tutor for Maceo, citing that it would interfere with his soccer practice.

Berry also alleges that Martinez is influencing Maceo’s perception of their conflicts, which has resulted in the boy returning from his father’s house angry and combative. Ultimately, Berry wants the court to grant her the authority to make decisions related to Maceo’s education and therapy.
The former couple met on the set of the film Dark Tide in South Africa in 2010. They got married in 2013 and welcomed Maceo in 2014, but announced their separation in 2015. The custody battle over their son was finally settled in 2023, with Martinez receiving $8,000 a month in child support and 4.3% of Berry’s income above $2 million.
As part of the agreement, Berry would cover all of Maceo’s medical expenses, health insurance, school tuition, and extracurricular costs. The agreement also stated that their son would attend individual and family therapy.

This comes after Berry lost her bid to force Martinez to attend co-parenting therapy to resolve conflicts around their son earlier this month. The pair had agreed to attend therapy in May to resolve disputes and conflicts between them in an effort to successfully co-parent Maceo.
However, Berry claims that Martinez decided to delay the sessions until September, citing a desire to take the summer off without clearing it with her or their therapist. She alleges that he did not attend July sessions to travel to his native France and wants to cancel August sessions due to his brother visiting.
Berry wanted a judge to force Martinez to adhere to the schedule laid out in the agreement, citing that the therapy sessions are conducted via Zoom and cannot be used as an excuse for travel.

Martinez’s team responded, arguing that Berry is constantly attempting to strong-arm him by forcing him into ‘submission’ using her wealth and legal professionals at her disposal. His lawyer added that Maceo faced ‘no immediate harm’ and alleged that Berry decided to file the request when she knew Martinez would be traveling – and that Berry’s request did not qualify for an emergency order.
